PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING EXCLUSIVE JURISDICTION PROVISIONS AND SPECIFIC WAIVERS OF CONSUMER WITHDRAWAL RIGHTS.
1. THE SERVICE & STRICT HUMAN-DELIVERY GUARANTEE
1.1 Nature of Service: Savantia ("we", "our", or "us") provides bespoke, premium English language proficiency preparation services, specifically focusing on IELTS writing correction, assessment, and pedagogical feedback (the "Services").
1.2 Strict Human-Centric Guarantee: Savantia prides itself on academic authenticity. We unequivocally guarantee that the core pedagogical assessment and the final feedback deliverables provided to the User are strictly generated, reviewed, and authorized by qualified human academic experts.
1.3 Exclusion of Third-Party AI Detection Liability: While we guarantee the human delivery of our final products, users acknowledge that contemporary linguistic patterns in academic writing may occasionally trigger false positives on experimental or third-party "AI detection" software. Savantia assumes no liability for, nor do we recognize the validity of, any claims of automated delivery based solely on unverified third-party algorithmic detection tools.
2. INTELLECTUAL PROPERTY, CONTENT LICENSING & USER WARRANTIES
2.1 User Ownership & Warranties: You retain all intellectual property rights to the original essays or content you submit (the "User Content"). By submitting User Content, you explicitly warrant that the content is your original creation, does not infringe upon any third-party copyrights, and constitutes a genuine attempt at academic practice (i.e., no intentional plagiarism).
2.2 Broad License Grant to Savantia: You grant Savantia a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and host the User Content for:(a) The primary purpose of delivering the customized Services to you; and(b) The secondary purpose of internal research, development, and training of future proprietary educational technologies (collectively, "Internal R&D"). Note: Any User Content utilized for Internal R&D will be strictly anonymized or pseudonymized. You may opt-out of this secondary use via our Privacy Policy without affecting your current Service quality.
2.3 Indemnification: You agree to indemnify and hold Savantia harmless from any claims, damages, or legal fees arising from your submission of plagiarized, offensive, or copyright-infringing materials.
3. DISCLAIMERS & NO SCORE GUARANTEE (EDUCATIONAL PURPOSE ONLY)
3.1 No Guarantee of Results: All Services provided by Savantia are strictly for educational, preparatory, and self-improvement purposes only. We expressly disclaim any representation, warranty, or guarantee, whether express or implied, that the use of our Services will result in achieving any specific score, band, or outcome on official examinations (including but not limited to the IELTS examination).
3.2 No Professional Reliance: Success in standardized testing is contingent upon numerous external factors beyond our control (e.g., baseline proficiency, test-day conditions). Our pedagogical feedback does not constitute an official testing authority endorsement.
4. PAYMENTS, REFUND POLICY & STATUTORY RIGHTS WAIVER
4.1 Customized Digital Labor: The User acknowledges that the Services constitute highly customized digital labor and intellectual effort that commences immediately upon order confirmation and submission of the User Content.
4.2 EXPRESS WAIVER OF STATUTORY WITHDRAWAL RIGHTS (EU/UK & Global): By placing an order and acknowledging these Terms, you expressly consent to the immediate commencement of the Services before the expiration of any statutory cancellation period (such as the 14-day cooling-off period under the EU/UK Consumer Rights Directive). You acknowledge and agree that by giving this consent, you irrevocably lose your statutory right of withdrawal once the performance of the Service has begun.
4.3 Default No-Refund Policy: Subject to Section 4.4, all sales are final. We do not offer refunds, partial or full, for Services that have been initiated, processed, or delivered.
4.4 Discretionary Negotiated Assessment: Users experiencing severe extenuating circumstances may submit a formal, written refund request to [Insert Support Email] within forty-eight (48) hours of the transaction. Savantia reserves the absolute, unilateral discretion to evaluate such requests on a case-by-case basis. Any refund granted is strictly an ex-gratia (goodwill) gesture.
4.5 Chargeback Abuse: Any attempt to circumvent our refund policy via unjustified credit card chargebacks or payment disputes constitutes a material breach of contract. Savantia reserves the right to suspend accounts and pursue legal recovery of disputed amounts and administrative costs.
5. LIMITATION OF LIABILITY & FORCE MAJEURE
5.1 Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVANTIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF ANTICIPATED SAVINGS, OR LOSS OF EDUCATIONAL/EMPLOYMENT OPPORTUNITIES, RESULTING FROM THE USE OR INABILITY TO USE THE SERVICES.
5.2 Liability Cap: IN NO EVENT SHALL SAVANTIA’S AGGREGATE LIABILITY EXCEED THE EXACT MONETARY AMOUNT ACTUALLY PAID BY YOU TO SAVANTIA FOR THE SPECIFIC INDIVIDUAL ORDER GIVING RISE TO THE CLAIM.
5.3 Force Majeure: Savantia shall not be liable for any delay or failure in performance resulting directly or indirectly from causes beyond its reasonable control, including but not limited to acts of God, global network or internet outages, regional telecommunication failures impacting our global network of academic experts, or governmental actions.
6. TERMINATION AND RIGHT TO REFUSE SERVICESavantia reserves the right, at its sole discretion, to refuse service, terminate accounts, or cancel orders without refund if a User violates these Terms, specifically including the submission of plagiarized material, engaging in abusive behavior towards our staff, or misusing the platform.
7. GOVERNING LAW AND EXCLUSIVE JURISDICTION
7.1 Governing Law: These Terms shall be governed by and construed strictly in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR), without regard to its conflict of law principles.
7.2 Exclusive Jurisdiction: You irrevocably agree that the Courts of Hong Kong shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, the Services, or your relationship with Savantia.
8. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
