1. GENERAL PRINCIPLE: THE FINALITY OF DIGITAL LABOR
1.1 Customized Digital Labor: Savantia provides highly specialized, human-delivered academic correction and pedagogical feedback. Due to the bespoke nature of these Services and the immediate, irrevocable allocation of expert academic resources upon order confirmation, all sales are considered final and strictly non-refundable by default.
1.2 Commencement of Service: The "performance of service" is legally deemed to commence the exact moment a User uploads, submits, or transmits their essay/text to our platform for correction.
1.3 Package and Bundle Finality: For Users purchasing bundled services (e.g., multi-essay correction packages), the entire bundle becomes non-refundable the moment the first component (e.g., the first essay) of that bundle is submitted. In the rare event an ex-gratia refund is granted for a partially used bundle, the consumed services will be retroactively calculated at the highest standard, non-discounted single-essay rate before any remaining balance is considered.
2. EXPRESS WAIVER OF STATUTORY WITHDRAWAL RIGHTS
2.1 Digital Service Exception: Under global consumer protection frameworks (including the EU/UK Consumer Rights Directive), the statutory 14-day "cooling-off" cancellation period does NOT apply to digital services that have been fully performed, or where performance has begun with the consumer's prior express consent.
2.2 User Acknowledgment: By purchasing our Services, you provide your explicit consent for Savantia to begin the service immediately and you irrevocably acknowledge that you waive your statutory right to cancel, withdraw from, or seek a refund for the contract once submission has occurred.
3. DISCRETIONARY NEGOTIATED ASSESSMENT (EX-GRATIA)
3.1 Application Process: Notwithstanding the strict no-refund rule, if you believe severe, verifiable extenuating circumstances exist, you may submit a formal request to [Insert Support Email] within forty-eight (48) hours of your transaction.
3.2 Ex-Gratia Nature: Any refund, credit, or partial reimbursement granted following such a request is strictly an "Ex-Gratia" (goodwill) gesture. It does not constitute an admission of liability, a recognition of service failure, or a waiver of this Policy for current or future transactions.
3.3 Administrative Deductions: Approved ex-gratia refunds will be subject to a deduction of non-refundable third-party payment gateway fees (e.g., Stripe/PayPal processing fees) and a reasonable administrative handling fee.
4. EXCLUSIONS & MERCHANT CURE PERIOD
4.1 Absolute Exclusions: Refunds will NEVER be granted for:(a) Subjective Dissatisfaction: Disagreement with the expert's pedagogical assessment, grading stringency, or feedback tone.(b) External Examination Outcomes: Failure to achieve a desired score in the official IELTS or any other examination.(c) Plagiarism or Policy Violation: Submissions containing plagiarized material or violating our Terms of Service.
4.2 Merchant Delay & Cure Period: If Savantia fails to return a corrected essay within the explicitly promised turnaround time due to technical errors on our end, the User must notify us in writing. Upon notification, Savantia reserves an absolute forty-eight (48) hour "Cure Period" to rectify the delay and deliver the Service. Only if Savantia fails to deliver the Service after this Cure Period expires will a full refund for that specific delayed service be processed.
5. ANTI-CHARGEBACK & FRIENDLY FRAUD DETERRENCE
5.1 Mandatory Direct Resolution: You explicitly agree to attempt to resolve any financial dispute via our Negotiated Assessment Process (Section 3) before initiating a chargeback or dispute with your financial institution.
5.2 Data Sharing for Fraud Prevention: To combat "friendly fraud" (e.g., false claims of unauthorized transactions), you authorize Savantia to share your IP address, device footprint, login timestamps, and the academic content you submitted with our payment processors and relevant banking institutions as definitive evidentiary proof of your utilization of the Services.
5.3 Breach & Recovery: Initiating an unjustified chargeback without adhering to Section 5.1 constitutes a material breach of contract. Savantia reserves the right to permanently terminate your account and pursue the original debt plus an Administrative Recovery Fee of [e.g., $100 USD] per fraudulent dispute through external collection agencies or legal avenues.
6. GOVERNING LAW AND EXCLUSIVE JURISDICTION
This Refund Policy shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising from this Policy shall be subject to the exclusive jurisdiction of the Courts of Hong Kong.
